Following RERA’s decision, applicant Geeta Mishra has got the actual possession of her house Tulip along with a compensation amount of Rs 2.81 lakh. The Authority had issued RRC to the district collector for recovery against the project located in Katara Hills Bhopal of non-applicant Signature Builders and Colonizers Pvt Ltd.

An agreement was presented on behalf of the applicant and non-applicant during a hearing held on September 30 in RERA. Later according to the Authority’s order, the non-applicant has entrusted the entire actual possession of the house and paid the entire compensation amount to the applicant. There is no dealing left between the two parties.

The applicant had got the case registered in the Authority on 6 April 2018. She had informed that according to the terms of the contract, she has not got the possession of the “Signature-360” villa number-164 (Tulip) house. The applicant had urged for possession of the building and increased amount of interest for delay. She was also asked to pay compensation for the house rent and mental harassment.

After hearing the case registered in RERA, it was decided to hand over the actual possession of the house to the non-applicant and pay compensation at the rate of Rs 6,000 per month for the delay. The compensation amount will be adjusted against the balance and other charges payable by the applicant. Along with this, the payment of compensation amounting to total Rs 10,000 should be paid to the applicant for causing mental harassment, physical pain and other problems. Apart from this, the application fee paid by the applicant in RERA will also be payable by the non-applicant.
