Ruby's bail plea rejected

PNS

Dehradun chief judicial magistrate has rejected the bail plea of Ruby Choudhary on Friday, stated defence lawyer Rajiv Raturi. Rautri further said the court has set next hearing on Saturday to take up the legality aspect of the formation of Special Investigation Team (SIT) by police.

He said the SIT can be formed by police only after the State Government issues notification. But in this case, SIT was constituted without the issuance of pertinent notification by the State Government, he added.

“Asked to clear things, police keep on changing statements to cover their vulnerability,” Rautri said. He said police have failed to clarify under what provision SIT was formed. Earlier, police told the court that SIT had been formed at the behest of the ADGP (law and order).  When pressed further, police said SIT had been formed under section 50 of Police Regulation Act 2007.  Raturi averred that under this act, police can form an inquiry team, not SIT.

He alleged that police are misleading the people regarding the case while seeking to shield the academy officials who are deeply involved.  He further said that he had filed a bail application in the court for Ruby on the ground that police have failed to present evidences before the court using which police have registered the case against his client in Mussoorie Police Station. However, the court rejected her bail plea on Friday.
