With an aim to improve the quality of service and ensuring better availability of authorised liquor in order to meet the demand of population keeping health hazards posed by illicit and spurious liquor, Delhi Cabinet has approved excise policy 2019-20 mainly for obtaining P-10 license.
The Delhi Government said it has been observed that the unlicensed eating houses, which are otherwise eligible for obtaining L-17/L-17F, L-18/L-18F licenses are misusing this facility by obtaining P-10 permits.
“Complaints are being received from various grievance redressal platforms — Public Grievance Monitoring Committee (PGMS), Chief Minister’s Janta Samvad, Control room of Excise department,” stated as mentioned in a statement from Chief Minister’s Office (CMO).
The Delhi Government further said based on the inputs, Excise Policy for the year 2019-20 will focus on the review of conditions for the grant of P-10 permit. According to new policy, P-10 permit shall be granted by Deputy Commissioner (Excise) for serving liquor. Delhi Government said as per the relevant rule 20(1) (c) P-10 permit may be issued by the Deputy Commissioner for specific occasion, for a specific limit to be determined in each case, on payment of prescribed fee.
“The holder of such permit shall be allowed to purchase, transport and serve liquor at a place specified in the permit, subject to conditions like - the area is screened off from public view, liquor is served only to adults above twenty years in age.
“Liquor is procured from licensed source in Delhi and shall produce purchase voucher on demand and if liquor is served outside the residence, P-10 permit shall be obtained even if the quantity of liquor to be served is equal to or less than the possession limit of an individual specified in clause (a) of sub rule (1)”, the Delhi Government stated.
As per the new policy, the registration would not be applicable for individual applying P-10 for hosting function at private residential properties and parks or community centres owned and maintained by local municipal bodies/gram sabha/contonment board.
To grant of license in Form - L1F, it is required to submit an affidavit declaring that the wholesale price declared in Delhi is lowest in comparison to wholesale price declared anywhere in India and shall not be allowed wholesale price more than the said WSP for any brand of Foreign Liquor.
“In case there is a reduction in wholesale price at anytime during the year, the licensee shall have to intimate the Commissioner Excise of such change immediately and in any case within 7 days failing which it shall be treated as breach of Terms and Conditions,” Delhi Government said.
“Any loss of excise revenue arising out of breach of terms and conditions shall be recovered from the licensee besides other proceedings which are liable to be initiated against the licensee as provided under the Delhi Excise Act, 2009 and Rules made there under,” a statement issued by the Chief Minister’s Office (CMO) read.
