The bail application of the 16-year-old accused of killing a seven-year-old boy at a private school in Gurgram's Bhondsi area was rejected by the Juvenile Justice Board (JJB) on Tuesday.
The accused is lodged at the correction home in Faridabad since November 11 after the Central Bureau of Investigation (CBI) nabbed him on November 7 on charges of murdering the Class 2 student of the school.
The CBI lawyer and the counsel for the seven-year-old victim argued that granting bail to the accused would be detrimental to the case.
The CBI in their reply asserted that in case Bholu petitioner (imaginary name given by the trial court) is granted bail he may tamper with the prosecution evidence and also influence the prosecution witness.
The agency also mentioned that he may abscond which would hamper the course of the trial so the bail plea should be dismissed.
The accused student's lawyer moved an application under section 12 of the Juvenile Justice Act, seeking his release on bail. The council said his client deserved bail under the act.
The defence lawyer in the bail application argued that the teenager has spent almost a year in the correction home and there no other concrete matter is available in the case. Also, the high court has also considered the teenager as minor.
The accused juvenile will be produced before the JJ Board on November 1.
The board member including Judicial Magistrate (first class) Pradeep Chaudhary of the Juvenile Justice Board will be interacted with him to ascertain his psychological capability.
Furthermore, on November 3, a medical board will consider the medical report and other related aspects in the case and will submit their views within a period of six weeks before the JJ Board.
"According to the high court directed the JJ Board will also review its decision within the span of six weeks whether the teenager will be tried as an adult or not.
A medical board will again consider all the aspects related to the case.
The accused had killed the seven-year-old boy brutally so he doesn't deserve bail," Sushil Tekriwal, lawyer for the seven-year-old victim, said.
The schoolboy was found with his throat slit outside a school toilet on September 8 last year.
