Vyapam charge-sheet against 4

The Central Bureau of Investigation has filed a charge-sheet against four accused persons i.e. a candidate, a solver and two middlemen U/s 120-B r/w 419, 420, 467/511,468 & 471/511 of IPC and 3(D)/4 of MPRE Act 1937 in the Court of Special Magistrate, CBI, Vyapam Cases, Gwalior.

 A case was registered by CBI on December 16, 2015 against the candidate and unknown persons in compliance of the orders of Supreme Court of India dated July 9, 2015 and took over investigation of FIR No; 590/12 registered earlier at Police Station, Janakganj against the candidate. It was alleged, inter alia in the FIR that an information was communicated through officials of Vyapam that one suspicious person was appearing in the Police Constable Examination, 2012 at laxmi Bai Smarak, Uttar Madhyamik Vidyalaya, laskar, Gwalior on September 30, 2012 in the name of candidate.

 The suspicious person was brought to the Principal’s room from where he went to toilet and cleverly fled from there.

Only OMR Sheet was given to the suspicious person by the time he was detected to be a case of Unfair Means (UFM). During the investigation conducted by the local police, the candidate, the middleman and solver could not be traced.

 Investigation made by CBI revealed that the candidate allegedly took the assistance of a middleman who in turn, took assistance of another middleman to arrange a solver to appear on behalf of the original candidate, in the written examination for which the Candidate agreed to pay `40,000 in advance out of a total amount of ` 2.5 lakh to be paid on getting selected.

 The middleman allegedly took the amount of Rs 40,000 and contacted other middleman to arrange a solver and paid him Rs 20,000 in advance. All the 4 accused persons were identified and traced. Specimen writings of candidate, solver and two middlemen were collected and sent to CFSl, New Delhi for forensic examination.

 On the basis of expert opinion, records and the identity proof, it was established that prior to the examination, solver, a middlemen and the candidate were present at a hotel in Gwalior. It was also established that the solver fraudulently impersonated the candidate through the said two middlemen and adopted unfair means for attempting selection as a Police Constable in the PCRT Examination 2012 conducted by Vyapam on September 30, 2012.

 The Court sent the middlemen to Judicial Custody till 01.02.2017 and issued NBW to other three accused as they did not appear before the court, when the charge-sheet was filed.
