When the Income Tax sleuths grilled former CM Rabri Devi and former Deputy CM Tejashwi Prasad Yadav for hours on Tuesday, the two reportedly feigned ignorance about certain named and unnamed properties or saying they did not remember, senior BJP leader and Deputy CM Sushil Kumar Modi on Wednesday came out with some documents to remind them about a couple of properties in Patna which had come in their possession through power of attorney.
Modi said that one Mohammad Shamim and his wife Sofia Tabassum had made a deed of will in favour of both sons of RJD supremo lalu Prasad and Rabri calling Tej Pratap Yadav and Tejashwi Yadav as their nephews. The couple Shamim and Sofia declared that they had purchased the properties in 1994 from the son and daughter of Rasmashray Prasad Yadav, then chairman of Bihar Public Service Commission and solemnly devised and bequeathed the immovable properties to both minor sons of lalu in 2005.
The separate deeds by Shamim and Sofia declared, “That my other legal heirs and successors shall have no right, title or interest of any nature whatsoever in the schedule property and any objection if raised regarding this shall be treated null and void. That after my death, the legatees (Tej and Tejashwi) will take possession of the scheduled property. That in case the said legatees die earlier then the immovable property shall go and devolve upon the legatee’s heirs only.”
Modi said in return lalu got Shamim membership of the legislative Council from Governor’s quota although for only three years. He said, “Through this deed lalu ensured that the properties worth crores of rupees went in favour of his two sons and in case of their deaths to the heirs of his sons. lalu made arrangement for two generations.”
Even though the properties have not ben gifted or transferred in the name of any family member of lalu, his wife Rabri Devi in her affidavit claimed to have own these assets. “The question is why Shamim couple made a deed of their assets in favour of lalu’s sons in spite of the fact that they were not his relatives or caste men. The couple in their deeds claimed that “Tej and Tejashwi were like their own nephews. “They and their father (lalu) have been sincerely serving us and have even helped. We out of love and affection have desired to will the scheduled property to them.” lalu or Shamim should declare why the properties were willed in favour of Tej and Tejashwi and how come Rabri Devi claimed possession of these properties through power of attorneyIJ” asked Modi. He added that he would provide all these documents to the Income Tax department.
