A mentally disabled man got the benefits of family pension scheme; courtesy Madhya Pradesh Human Rights Commission (MPHRC).
Jabalpur resident Shahshikant Mishra had lodged a complaint with the MPHRC that the Higher Education Department is not giving family pension to his youngest brother Rishikant Mishra who could neither speak, nor walk and could not even express his pain and sorrows as he is completely mentally and physically disabled.
Mishra in his complaint brought to the knowledge of the Commission that his father who breathed his last on in 2012 was retired from the post of professor from DN Jain College Jabalpur. His mother had expired earlier in 2006 and his youngest brother is 100 per cent disabled was dependent on mother for his livelihood. But the Higher Education Department has stopped family pension to him since last three years causing severe problems in his life, he added.
The Commission after gearing his plea asked the Commissioner higher education department to file government’s reply over the issue. The Commission also wished to know from the Commissioner that when he has already got the opinion of director in the issue that as to why the action is delayed in the case by the administrative department.
The Commission observed prima facie that the case reflects the insensitiveness of the department and that it is due to this insensitive attitude of the department that a mentally and physically disabled person is not able to get his rights. That too when the pension rules clearly states that under pension rule 1976’s rule 47 (6) has the provision that he should get the family pension.
The Commission wrote to Principal Secretary Higher Education Department to take action as per the opinion of Director Pension and Provident Fund as there seems no reason to stop pension to mentally disabled Rishikant Mishra and intimate about the action taken over the issue to Commission before September 30, 2015.
The Complainant Shahshikant Mishra has informed the Commission that the Commissioner Higher Education Department has released his mentally disabled brother’s pension orders and that he is grateful to the Commission.
