Court nixes CBI Budaun report, summons accused Pappu

Saturday, 31 October 2015 | PNS | New Delhi

Rectifying a major error by CBI in filing a closure report against one of the accused, who allegedly involved in intimate relations with a minor Dalit girl, who along with her sister committed suicide later, a Budaun special court has trashed the final report against Pappu Yadav and summoned him as an accused.

Taking cognisance against accused Pappu for prima facie commission of offences under Sections 354 (outraging the modesty of a woman), 363 (kidnapping from lawful guardianship) and 366 (kidnapping or inducing for illicit intercourse) of the IPC and Section 7/8 of Protection of Children from Sexual Offences Act, 2012, the court has directed him to appear before it on November 28.

However, the court has accepted the CBI’s closure report against four other accused persons — Avadhesh and Urvesh (brothers of Pappu), constable Sarvesh Yadav and head constable Chattarpal as the alleged offences of rape and murder of the two minor Dalit girls was found in the CBI probe. Instead, the two girls had committed suicide  by voluntarily climbing the tree  and hanging themselves by using their own dupatta to the fear of stigma after one of them was allegedly caught by a villager in a compromised position along with the accused Pappu Yadav.
