The National Human Rights Commission (NHRC) has sought a report from the Superintendent of Police of Gautam Budh Nagar district of Uttar Pradesh within four weeks over its failure in investigating the case of mysterious death of Binataswa Mallick, an MBA student from Odisha,in Noida.
The apex human rights watch dog passed the order while acting on a petition filed by rights activist Radhakanta Tripathy.The petitioner stated that the death of Binataswa Mallick, who had died on the night of September 18 last year in Noida’s Sector 108, remains mysterious since the investigation is not proper. The actual reason for the accident is yet to be revealed.
Father of the deceased alleged that Noida police have not proceeded in investigating the case despite an FIR being lodged on September 19. In the FIR, the victim’s father has demanded arrest of Binataswa’s two friends as well as the truck driver responsible for accident, as well as seizure of the offending vehicle.
Grief torn father of the deceased said the investigating officer is showing an indifferent attitude towards the case and has failed to provide the postmortem report to the family though three weeks have already passed. The family of the deceased has also intimated the IG (Meerut range) regarding the non-cooperation of the local police. The investigating officer made a statement that a DNA test was not possible as it is very expensive and catching the truck and its driver may take more than a month.
“All these facts and circumstances lead to failure of the State in ensuring justice to the bereaved, grief shattered family. Criminal justice in the instant case remains a question mark and mystery till date,” Radhakanta contended.He urged the Commission for an impartial investigation into the case, besides compensation to the kin of the deceased.
In the case related to the attack on lincon Subuddhi at Noida the Commission has warned the police of taking coercive action in case it fails to submit detailed report as it has already failed to comply the reminder issued by the NHRC.
