Gujarat riot myths busted

Abraham Thomas | New Delhi

The so-called human rights activist, Teesta Setalvad — who paraded the Gujarat riot victims before the Supreme Court and claimed they had been denied justice — suffered embarrassment on Monday after a Special Investigation Team (SIT) gave sufficient grounds for the apex court to doubt the authenticity of incidents highlighted by her NGO Citizens for Justice and Peace.

The SIT, headed by former CBI Director RK Raghavan along with former DGP CB Satpathy and three senior IPS officers — Geetha Johri, Shivanand Jha and Ashish Bhatia — had been entrusted with the enquiry into post-Godhra riot incidents in Godhra, Gulbarg Society, Naroda Gaon, Naroda Patiya and Sardarpura.

Senior advocate Mukul Rohtagi, appearing for the State, read out portions of the report that refuted the petitioner’s charge of the State’s complicity in the riots.

Pointing out a specific instance, the SIT report stated how the evidence of 22 witnesses was “suspect” owing to the identical submissions made in their affidavits submitted to the court. On enquiry, the SIT found that all the 22 affidavits were drafted, typed and printed from the same computer, giving sufficient grounds to believe they were “tutored”. When the SIT questioned those who signed the affidavits, it was shocked to learn that these complainants were not even aware of the incidents.

Referring to another instance that exposed the Citizens for Justice and Peace’s much ‘trumpeted’ charges, Rohtagi said the SIT investigation found untrue allegation about a gangrape of a pregnant woman Kauser Bano, whose stomach was allegedly pierced by sword and her foetus killed.

Even the instance of dumping of bodies into a well at Naroda Patiya and a charge of the police allegedly shielding accused persons in murder of a British national was found to be untrue, Rohtagi said.

Firing a salvo at the NGO, Rohtagi said, “It is clear from the report that the horrendous allegations made by the NGO were false. Cyclostyled affidavits were supplied by a social activist and the allegations made in them were untrue,” he added, with an obvious reference to Setalvad.

The NGO’s counsel Aparna Bhatt objected to such comments being made on the strength of the report, which had also added several persons as accused in the case. Refusing to be drawn into the slanging match between the opposing parties, the Bench headed by Justice Arijit Pasayat said, “In riot cases, more the delay, there is likelihood of falsity creeping in. So, there should be a designated court to fast track the trials.”

The court asked the State Government, petitioners and amicus curiae senior advocate Harish Salve to suggest recommendations on these lines. Additional Solicitor General Gopal Subramanium, appearing for the Centre, suggested selection of public prosecutors on consultation from the SIT. Salve informed the court that the matter would be taken up with the SIT. Based on a suggestion by another NGO petitioner counsel Indira Jaising to evolve a witness protection system, Salve assured that the same would also be discussed in the light of the sensitivity attached to the case. The bunch of petitions was posted for further hearing after next week.

Bullet Secularism
By Suresh on 4/23/2009 1:23:22 PM

These are the real anti social elements in this society and they flourish becasue we have never learnt to unite and fight for our cause. Till then we will be taken for a ride in the name of secularism by the media.

The quick profit seeking media, totally controlled by the corporate world, cannot be expected to raise Indian morals. It is as much a part of the rat race world as the so called new Indian elite. Are you ready to pay the price for discarding your faith in the great creator of this universe & golryfying secularism? Does the solution lie in holding five yearly elections under a true to the book election commission? As is, the majority, including the so called elite, have only contempt.

Bullet setalwad must be exposed
By upendra on 4/16/2009 12:36:34 PM

it is surprising that the news is missing from electronic media. her remarks on Dhule riots is an example that she is biased and should not be believed. but she is supported by congress.

By vinayak on 4/14/2009 9:46:33 PM

Notice that this story is barely mentioned in the 'secular' media(NDTV,CNN IBN etc.).Notice that though the EC forbade polls from being aired,NDTV cleverly posted the 'results' of their polls and it remained posted after the EC deadline.Notice that after VG it is the turn of Ashok Sahu, notice that only BJP candidates are being hounded.

Bullet Teesta and Gujarat Riots
By RAJ on 4/14/2009 8:07:26 PM

Teesta Setalvad and her NGO should be fully investigated and exposed. They should be tried and punished and all honours bestowed by UPA Govt should be taken away. This shows how many NGOs are working against the Hindus and the country. She must be named and shamed in public.

Bullet Bring such NGOs to Books
By Rajesh Patel on 4/14/2009 7:21:36 PM

CM MODI and the GOVT of Gujarat must file a multi crore defamatory legal case against the NGO, and Ms.Teesta Setalvad. This will teach such NGOs a lesson not to mislead people of country and state against incorrect allegations. The media who have used her statements are free, but the media which have imposed and spread such statements to mislead people must also be listed in the legal law-suit.

By ashok pai on 4/14/2009 7:06:32 PM

this is a very important news. secular like javed akhthar and others have used the kausar bano killings case, even pakistan based bloggers have used it as their ammo. this is the duplicity of this lady who has spawened stories on her own. her neutrality is now destroyed. her awards must be stripped off. the media has been deafeningly silent on this issue too. this should be hitting the headlines. because when she shouted she got the headlines, no less!!!!

Those who shout the loudest do not necessarily speak the truth. They probably shout so loud, so hard for so long so that their own personal agendas are served. Their personal agenda does not figure in the truth and truth certainly does not figure in their personal agenda. They do it to enhance their going-nowhere careers, effectively a frustrated bunch of do gooders upto no good.

Bullet Sad story if true
By David on 4/14/2009 5:36:30 PM

Well if these were not victims, then it is even more a sad story because the riots did happen and people did lose their lives and they have not got justice. i dont think no body is working from outside India to malign India it is just Indians themselves. I used to study in School that there is Unity in diversity in India. Yes there is some of that left, till someone uses hate speech to rouse up people to create havoc.

Bullet investigate ngos
By vinayak on 4/14/2009 12:07:10 PM

One must exercise caution, but these facts need to be investigated thoroughly. It is quite possible that such fake affidavits were created and supported not just by Ms. S but also by tehelka.A very careful and painstaking investigation, including motives must be carried out on such agencies and if found to be guilty, they should be tried for high treason.

Bullet Gujarat should file a suit against Began Setalwad
By Latha on 4/14/2009 11:17:14 AM

It is time that Gujaratis took this unscrupulous NGO fabricator to the cleaners for defamation and for besmirching their community in India and the world over. There must be a serious price to pay and real consequences for dissembling and using taqiya in the cause of the ummah (or the Comintern as the case may be). Her accomplice, Suzy Roy, already exposed as an unabashed liar for her wild fiction, waltzed away unfazed to lie another day.

Bullet An enquiry is needed in the case of NGOs too
By KSV SUBRAMANIAN on 4/14/2009 7:54:30 AM

It seems somebody is working at the behest of some foreign powers to malign the Indian State and democracy. A comprehensive inquiry should be instituted to bring out the facts. It should also be enquired why only Hindu religion, its religious outfits, organizations become the target of malignment when much more evil deeds are done by others. There seems to be a secret agenda behind all of these.

Bullet Padmashree award must be stripped off from her
By Ramesh Patil on 4/14/2009 2:27:48 AM

Teesta Setalvad must be sent to Pakistan or Bangladesh or Saudi Arabia. As per her statement on Marathi Channel IBN-Lokmaat two months ago, in reference to "DHULE RIOTS" where poor hindu womens were raped by Muslim Armed Men, she says, who knows this is done by Muslims, and the police have arrested Muslims in this connections. Her Padmashree award must be stripped off for taking being biased against HINDUS.
